OSHA Retail Exemption – Interim Enforcement Policy

In an Interim Enforcement Policy update on December 23, 2015, OSHA examines and explains the retail exemption for the Process Safety Management (PSM) standard.  In short, a retailer must be engaged under NAICS Codes 44 and 45 in order to qualify for the retail exemption.  The previous exemption has been extended through September 30, 2016.  Following this date, unless another update is issued, OSHA may issue violations to facilities not meeting the requirements of either the retail exemption or PSM standards.
